The rules for using Cubinus as a customer, owner or visitor.
1. About these terms
These Terms & Conditions govern your use of the Cubinus website and related services (together, the “Platform”). Cubinus is operated by [legal entity name], [registered address] (“Cubinus”, “we”, “us”). By using the Platform you agree to these terms and to our other policies referred to below.
2. What Cubinus does
Cubinus is a service-led digital marketplace that helps people and businesses discover, verify, visit and lease PG accommodations and office spaces, starting in Noida. We combine online listings with field checks and an assigned advisor.
Unless we say so in writing, Cubinus is not the owner, landlord or tenant of any listed space, and is not a party to the rental or lease agreement between a customer and an owner.
3. Who can use the Platform
You must be at least 18 years old and able to enter into a binding contract under Indian law. If you act for a business, you confirm you are authorised to do so.
Owners, PG operators and managers who list a property confirm that they own it or are authorised to market it.
4. Listings and information
We check listings through a defined process (see our Listing & Verification Policy). Even so, details such as price, availability and terms can change. We reconfirm availability and key terms before a visit, but you should read the final agreement carefully before you commit.
A Cubinus check is not a legal certification, government approval, police clearance or guarantee of safety.
5. Your responsibilities
You agree to give accurate information, to use the Platform lawfully, and not to:
- misrepresent your identity, ownership or authority;
- post false, misleading or duplicate listings, or use media you do not have the right to use;
- sublet, or broker, without authority;
- copy, scrape or misuse Platform content or interfere with its operation;
- harass, threaten or discriminate against any person.
6. Fees
Browsing and enquiring are free. Cubinus may charge a service fee on a successful transaction. The amount, who pays it and when it falls due are disclosed in writing before you commit. See our Brokerage & Service Fee Policy and Refund & Cancellation Policy.
7. Rent and deposits
Rent and security deposits are agreed and paid directly between the customer and the owner under their agreement. Cubinus does not hold rent or security deposits by default. If that ever changes, we will tell you clearly and the terms will be set out in writing first.
8. Visits and bookings
Visit slots are subject to the owner’s and your availability. Please tell us if you cannot attend. Cubinus is not responsible for losses that arise from an agreement you make directly with an owner.
9. Services from partners
Some services shown on the Platform (for example rental or sale agreements, home loans, legal services and interiors) are provided by partner professionals. Their fees and terms are shared before you proceed, and those services are subject to the partner’s own terms and applicable law.
10. Intellectual property
The Cubinus name, logo, design and content belong to us or our licensors. Photos and media supplied by owners remain theirs, and owners give us permission to display them on the Platform.
11. Limitation of liability
To the fullest extent permitted by law, Cubinus is not liable for indirect or consequential losses, or for the acts or omissions of owners, customers or third parties. Nothing in these terms limits liability that cannot be limited by law.
12. Suspension and removal
We may pause or remove a listing, or suspend access, where we suspect fraud, misrepresentation, a breach of these terms, or where an owner cannot show authority.
13. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continued use means you accept the updated terms.
14. Governing law
These terms are governed by the laws of India. Subject to applicable law, the courts at [city / district] have jurisdiction.
